General Terms of Use for Chargeable Parking Spaces
Scope
These terms of use regulate the use of chargeable parking spaces (in the following referred to as "parking spaces") operated by the Schmittenhöhebahn AG., The user accepts these terms by using the parking spaces.
Contract Subject
The Schmittenhöhebahn AG provides the user with a parking space for a passenger car at the parking areas near the valley station of the Sonnenalmbahn (PP1) and the valley station of the areitXpress (part of PP2). This contract does not include a guarding or custody agreement. The Schmittenhöhebahn AG assumes no liability for theft or damage to vehicles or their contents.
Use of the Parking Space and Fees
A barrier opens when entering the parking lot. The user is required to take a ticket to use the parking space. The parking fee is EUR 10.00 per day and must be paid either before leaving at the designated payment machines or upon exit. Overnight parking is prohibited between 8.00 PM and 7.00 AM. Vehicles parked unlawfully during this period will be subject to an additional night surcharge of EUR 20.00 in addition to the regular fee.
User Obligations
The user is required to comply with applicable traffic regulations and use the parking space properly. Parking outside designated spaces is prohibited. The user must keep the issued ticket safe. A replacement fee may be charged for lost tickets.
Liability of the Schmittenhöhebahn AG
The Schmittenhöhebahn AG is only liable for damages caused by intent or gross negligence. The company assumes no liability for damages caused by third parties. The Schmittenhöhebahn AG does not assume liability for force majeure (e.g., natural disasters).
Contract Duration and Termination
The contract for the use of the parking space begins upon entry and ends upon exit of the vehicle. The Schmittenhöhebahn AG reserves the right to remove vehicles parked without valid authorization or in violation of the overnight parking ban at the owner's expense.
Data Protection
The Schmittenhöhebahn AG processes users' personal data exclusively in accordance with legal provisions. Further information on data protection can be found in the privacy policy available on-site or on the operator's website:

Final Provisions
Should any provision of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected. Austrian substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules under private international law. If the customer is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), any legal disputes shall be resolved by the court with jurisdiction over the user's residence, habitual residence, or place of employment. If the consumer resides in the EU, they may bring an action either before the competent court in Salzburg or before the court of their place of residence. In all other cases, the competent court at the company’s registered office shall have jurisdiction.
